The service

Sales Caller ("we", "us") is an Ounie product that places outbound phone calls to lead lists you upload, using an AI voice agent that answers from the content of your own Ounie brain, and logs the outcome, recording, and transcript of each call. You ("you", "the customer") pay for usage at the rates published on our pricing page, in Ounie credits.

You are the caller of record

This is the part to read twice. Calls are placed on your behalf, at your direction, to lists you provide — which makes you, not us, the caller of record. Telemarketing and robocall law (including TCPA and state equivalents, where they apply) is your responsibility. We build compliance guardrails into the dialer — AI disclosure, calling-hour enforcement, recording preambles, a permanent opt-out registry — but guardrails are not a guarantee of compliance, and we do not provide legal advice.

Consent attestation

Before any campaign dials, you must attest that you have the consent required to call every number on the list and that you have scrubbed it against applicable do-not-call registries. That attestation is recorded with the campaign. Uploading a list you have no right to call is a material violation of these terms.

Acceptable use

You may only run campaigns from brains your Ounie account can access. You will not use the service for scams, impersonation, harassment, calls to emergency lines, or any campaign designed to evade the built-in guardrails. We may pause or suspend campaigns that generate abuse complaints, unusual opt-out rates, or carrier flags — with notice where practical, immediately where necessary.

Account & billing

There is no subscription. Usage is billed in Ounie credits from your shared Ounie wallet: per connected minute in 6-second increments, per voicemail message left, and a one-time activation charge per campaign, at the rates on /pricing. Every call reserves a deposit before dialing and refunds the unused remainder automatically at settle. Credits are purchased and managed on ounie.com; your call logs, transcripts, and recordings remain accessible regardless of your credit balance.

Failed payment

If your wallet runs out of credits, campaigns pause — nothing dials without a reserved deposit, so your balance can't go negative. Buying credits resumes paused campaigns. We do not delete your data because of an empty wallet.

Refunds

Unused deposits refund automatically on every call. Unanswered dials are never charged. If a call fails on our side — a platform error, not a lead hanging up — the charge is reversed. For anything else, open a support ticket.

Service availability

We target 99.5% monthly uptime for the dashboard and dialer. Answer quality depends on what your brain contains: the agent answers only from your sources, says so when it doesn't know, and never pads an answer with outside knowledge.

Liability

Our liability is capped at the amount you paid us in the prior 12 months. We are not liable for indirect, incidental, or consequential damages, or for regulatory consequences of campaigns you ran as the caller of record.

Termination

Either party can terminate at any time. You retain access to data you've already paid for. We may suspend accounts for material violations of these terms with notice.
